Bid BIM — Supplemental Terms of Service

These Bid BIM Supplemental Terms ("Bid BIM Terms") govern Customer's access to and use of the Bid BIM self-serve service (the "Bid BIM Services") and supplement and form part of the ConstructAI Terms of Service available at constructai.la/terms (the "General Terms"). These Bid BIM Terms are "Supplemental Terms" as defined in the General Terms. Capitalized terms used but not defined here have the meanings given in the General Terms. If there is a conflict between these Bid BIM Terms and the General Terms with respect to the Bid BIM Services, these Bid BIM Terms control to the extent of the conflict. Except as expressly modified or supplemented here, the General Terms remain in full force and apply to the Bid BIM Services.

  1. 1. SELF-SERVE ACCESS AND ACCOUNTS

    1. 1.1 Self-Serve Model

      The Bid BIM Services are provided on a self-serve basis. Notwithstanding the quotation and order process described in Section 1.1 of the General Terms, Customer may access the Bid BIM Services, submit Input, and receive Output directly through the platform without submitting a request for a quote or awaiting Company review. The quote-based steps of the General Terms do not apply to the Bid BIM Services.

    2. 1.2 Account Registration

      To use the Bid BIM Services, Customer must create an account and provide accurate, current, and complete registration information and keep it updated. Customer represents that it is at least 18 years old and, if registering on behalf of an entity, that it is authorized to bind that entity to the Agreement. Customer is responsible for all activity under its account and for maintaining the confidentiality of its credentials, consistent with Section 2.3 of the General Terms.

    3. 1.3 Automated Processing

      Customer acknowledges that the Bid BIM Services generate Output automatically through the Models, without human review of Input or Output by Company prior to delivery. Section 7.3 of the General Terms (Disclaimers) applies to all such Output.

  2. 2. FREE TRIAL

    1. 2.1 One Free Project

      Each newly registered account is eligible to generate one (1) project model at no charge (the "Free Project"). The Free Project is a one-time entitlement per Customer.

    2. 2.2 "As Is."

      The Free Project is a no-charge Service and is provided "as is" and without warranty of any kind, as set forth in Section 7.3(Y) of the General Terms.

    3. 2.3 After the Free Project

      Each project after the Free Project is a paid project, charged in accordance with Section 3 below.

    4. 2.4 Anti-Circumvention

      Company may suspend, limit, or revoke access, withhold Output, or charge applicable Fees if it reasonably determines that Customer has created multiple accounts or otherwise acted to obtain more than one Free Project.

  3. 3. PER-PROJECT FEES AND PAYMENT

    1. 3.1 Per-Project Pricing

      The Bid BIM Services are billed on a per-project basis at the Fees presented at the time of order. The Bid BIM Services are not sold on a subscription or recurring basis, and no recurring Fees apply.

    2. 3.2 No Credits or Tokens

      Bid BIM Fees are charged per project and are not based on tokens, credits, or prepaid balances. To the extent the General Terms reference consumption of tokens or similar units, those provisions do not apply to the Bid BIM Services; the usage and anti-abuse controls in Section 2.5 of the General Terms otherwise continue to apply.

    3. 3.3 Payment Method and Processor

      Customer will pay Bid BIM Fees by a valid payment method (such as a credit or debit card) through Company's third-party payment processor Stripe. Customer authorizes Company and its payment processor to charge Customer's designated payment method for each paid project Customer orders, together with any applicable taxes. Customer's use of the payment processor may be subject to the processor's own terms, and Customer is responsible for reviewing and complying with them.

    4. 3.4 Timing

      Except for the Free Project, payment is collected at the time of order and before the corresponding project is processed, consistent with Sections 1.1 and 5 of the General Terms.

    5. 3.5 Taxes

      Taxes are handled as set forth in Section 5.2 of the General Terms.

  4. 4. INPUT ACCURACY AND AUTOMATED RESULTS

    1. 4.1 Customer Responsibility for Input

      Because the Bid BIM Services process Input automatically and without human review, Customer is solely responsible for ensuring that its Input (including blueprints and drawings) is accurate, complete, legible, and in a supported format. Section 2.3(c) of the General Terms applies.

    2. 4.2 Automated Assumptions

      Where Input is incomplete, ambiguous, or contains errors, the Bid BIM Services may proceed using automated assumptions. Output generated on the basis of such assumptions is a deliverable under the Agreement, and Customer remains responsible for reviewing and assessing the suitability of all Output as set forth in Section 7.3(Z) of the General Terms.

    3. 4.3 Re-Processing Charged Per Project

      Any re-processing or correction of a project, including to address errors or omissions in Customer's Input, constitutes a new paid project and is charged separately. This Section 4.3 is the self-serve equivalent of, and replaces, Section 1.1.5 of the General Terms with respect to the Bid BIM Services.

    4. 4.4 Acceptance and Refunds

      The 48-hour review and refund window described in the General Terms applies to paid Bid BIM projects. The Free Project, being provided at no charge, is not eligible for a refund.

  5. 5. NO OTHER CHANGES

    Except as expressly set forth in these Bid BIM Terms, all provisions of the General Terms — including those governing Output ownership (Section 3.4), Confidentiality (Section 4), Information Security (Section 1.5), Warranties and Disclaimers (Section 7), Limitation of Liability (Section 9), and Dispute Resolution (Section 10) — continue to apply to the Bid BIM Services without modification.
